Settlement Week
The District Courts, the County Courts at Law, and the County Court of Smith County designate two weeks each year as SETTLEMENT WEEKS.  This designation is made to comply with Sec. 155.001 et seq., of the Texas Civil Practice and Remedies Code and to allow the Courts, through the process of mediation, to dispose of as many pending cases as possible.  The first Settlement Week of 2014 has been scheduled by the Administrative District Judge for January 21-24, 2014.
 
All cases for mediation during Settlement Week will be ordered by the Court. Multiple party cases and those over $25,000 in controversy are not appropriate for Settlement Week. The deadline for submitting a case is set to allow sufficient time for all parties to arrange to attend the mediation. The mediation will be a two-hour session. Mediators may limit the issues appropriate for the time allowed.

INSTRUCTIONS FOR ATTORNEYS
Please submit the case no later than Wednesday, January 15 to allow time for the Judge to sign the Order.

Each attorney may submit a maximum of two cases.  Complete one form for each case submitted.

Settlement Week Mediators MAY be selected by the parties.
As with private mediation, the parties should agree on the mediators. 
Please confirm with the mediator that they are willing to volunteer their time for the Settlement Week mediations.
 
 
SCB will continue to appoint mediators for cases that do not designate an agreed mediator.

All $100 per party Administrative Fees must be paid before Mediation.
The fee is a non-refundable fee and is a donation to the Smith County Bar Foundation.
The fee must be paid within five (5) days after submitting the case for mediation.
The mediation will not be held unless all parties have made their donation. 
No refund will be given if the case is scheduled and then settled prior to the mediation.
Mediators are volunteering their time and expertise for the Smith County Bar Foundation. 
Pro bono cases will be accepted according to the local Lone Star Legal Aid guidelines and exemption from fees must be granted by the Court before Settlement Week.
